La sua vita piuttosto movimentata lo porta anche a scontare cinque anni in carcere. Quando esce, nel 1901, comincia a pubblicare alcuni racconti di vita carceraria (come "Una riforma riattivata", che diventerà una commedia di Armstrong e un film). La prima antologia, "Cabbages and Kings", sarà pubblicata nel 1904.
Scrive oltre 600 racconti, in parte raccolti in popolari antologie: "The Four Million" (1906), "Heart of the West and The Trimmed Lamp" (1907), "The Gentle Grafter and The Voice of the City" (1908), "Options" (1909), "Whirligigs and Strictly Business" (1910) e altre pubblicate dopo la sua prematura scomparsa.
Alcolista, muore a New York (Stati Uniti) a soli 47 anni, il 5 giugno 1910.
Narratore di grande efficacia, molto coinvolgente, permea i suoi racconti di distaccata ironia. Molto pubblicato anche in Italia, è considerato uno dei maggiori narratori e umoristi statunitensi.
Il famoso racconto "Un'ambizione", illustrato da Piero Bernardini, viene pubblicato nel 1948 in appendice a Il romanzo per tutti n. IV/12
